CONCERNING
IMPLEMENTATION DIRECTIVE ON THE COLLECTION OF SAFEGUARD MEASURES IMPORT DUTY ON THE IMPORT OF CANVAS PRODUCTS MADE FROM SYNTHETIC FIBER OTHER THAN AWNING AND SUNSCREEN

Attachment

Considering:

a. that in the framework to implement provisions in Regulation of the Minister of Finance No. 176/PMK.011/2011 dated November 17, 2011 concerning the Imposition of Safeguard Measures Import Duty on the Import of Canvas Products Made From Synthetic Fiber other than Awning and Sunscreen, it is necessary to regulate the implementation directive;

b. that based on consideration as intended in paragraph a, it is necessary to stipulate Regulation of the Director General of Customs and Excise concerning Implementation Directive on the Collection of Safeguard Measures Import Duty on the Import of Canvas Products Made From Synthetic Fiber other than Awning and Sunscreen.

In view of:

1. Law No. 7/1994 concerning Ratification of Agreement Establishing The World Trade Organization (Statute Book of the Republic of Indonesia No. 57/1994, Supplement to Statute Book of the Republic of Indonesia No. 3564);

2. Law No. 10/1995 concerning Customs (Statute Book of the Republic of Indonesia No. 75/1995, Supplement to Statute Book of the Republic of Indonesia No. 3612) as amended by Law No. 17/2006 (Statute Book of the Republic of Indonesia No. 93/2006, Supplement to Statute Book of the Republic of Indonesia No. 4661);

3. Government Regulation No. 34/2011 concerning Antidumping Measure, Compulsory Measure, and Trade Safeguard Measure (Statute Book of the Republic of Indonesia No. 66/2011, Supplement to Statute Book of the Republic of Indonesia No. 5225);

4. Presidential Decree No. 56/P/2010;

5. Regulation of the Minister of Finance No. 176/PMK.011/2011 dated November 17, 2011 concerning the Imposition of Safeguard Measures Import Duty on the Import of Canvas Products Made From Synthetic Fiber other than Awning and Sunscreen;

DECIDES:

To stipulate

IMPLEMENTATION DIRECTIVE ON THE COLLECTION OF SAFEGUARD MEASURES IMPORT DUTY ON THE IMPORT OF CANVAS PRODUCTS MADE FROM SYNTHETIC FIBER OTHER THAN AWNING AND SUNSCREEN

Article 1

On the import of canvas products made from synthetic fiber other than awning and sunscreen in the heading ex 6306.12.00.00, subject to Safeguard Measure Import Duty.

Article 2

Safeguard Measure Import Duty as intended in Article 1 shall be imposed for 3 (three) years under the following condition:

1 1st Year, one year period since promulgation date of this Regulation of the Minister of Finance. Rp 13,643 per kilogram
2 2nd Year, one year period since ending date of 1st year period. Rp 12,643 per kilogram
3 3rd Year, one year period since ending date of 2nd year period. Rp 11,643 per kilogram

Article 3

The Safeguard Measures Import Duty as intended in Article 1 shall be imposed on the import of canvas products as intended in Article 1, that are produced from all countries except produced in countries as stated in Attachment I of this Regulation of the Director General which is an integral part of this Regulation of the Director General.

Article 4

(1) Imposition of Safeguard Measures Import Duty as intended in Article 1 is:

(2) In case provisions in Common Effective Preferential Tariff Schemes are not fulfilled, imposition of Safeguard Measures Import Duty on the import from countries are in international goods trading agreement schemes as intended in paragraph (1) b shall be Most Favored Nation as intended in paragraph (1)a.

Article 5

The import of canvas products made from synthetic fiber other than awning and sunscreen from countries excepted from the imposition of Safeguard Measures Import Duty as intended in Article 3 and from countries has trading cooperation with Indonesia as intended in Article 4 paragraph (1) b, importer shall submit Certificate of Origin.

Article 6

Provisions of Safeguard Measures Import Duty Tariff as intended in Article 2, shall apply to the import of goods whose import customs notification has secured registration number from the Customs Office at the port of entry since effective date of Regulation of the Minister of Finance No. 176/PMK.011/2011 dated November 17, 2011 concerning the Imposition of Safeguard Measures Import Duty on the Import of Canvas Products Made From Synthetic Fiber other than Awning and Sunscreen.

Article 7

On the import goods are imposed Safeguard Measure Import Duty, beside should pay Import Duty and Tax in the Framework of Import (PDRI) by using import customs notification, also should pay Safeguard Measure Import Duty and additional PDRI in relation with imposition of Safeguard Measure Import Duty by using payment basic documents of:

Article 8

(1) Safeguard Measure Import Duty is calculated based on net weight of canvas products made from synthetic fiber other than awning and sunscreen as intended in Article 1 multiplied with Safeguard Measure Import Duty tariff as intended in Article 2.

(2) Additional PDRI in relation with imposition of Safeguard Measure Import Duty is calculated based on percentage of PDRI tariff multiplied with Safeguard Measure Import Duty.

Article 9

Payment and remittance of Safeguard Measure Import Duty and additional PDRI in relation with imposition of Safeguard Measure Import Duty by using SSPCP Account Code for Safeguard Measure Import Duty and using PDRI Account code for additional PDRI in relation with imposition of Safeguard Measure Import Duty.

Article 10

(1) Head of Customs Office makes monthly report of the implementation of imported goods are imposed Safeguard Measure Import Duty to the Director General with attention to Director of Customs Technique by using format as set out in Attachment III that is an integral part of this Regulation of the Director General.

(2) Report as intended in paragraph (1) should be submitted although there is no payment of Safeguard Measure Import Duty.

Article 11

(1) This Regulation of the Director General is effective for 3 (three) years since effective date of this Regulation of the Director General.

(2) This Regulation of the Director General shall come into force since November 17, 2011.
